چکیده | ||
در میان شیوههای شکایت از آرای مدنی، «پژوهشخواهی» پرکاربردترین آنها است. به این شیوه شکایت در مواد 330 تا 365 قانون آیین دادرسی مدنی و در دیگر قوانین اشاره شده است. صدور آرای وحدت رویه پرشمار، دلیلی برای اهمیت بالای این راه شکایت از رای است. بر همین بنیاد، جُستارهای بسیاری پیرامون آن انجام شده اما پُرسِمان گرانمایهای که شایسته توجه بیشتری بوده، آن است که پژوهشخواهی بر پایه کدام هدفها شکل گرفته و چه سیاستهایی در ورای آن نهفته است. این نوشتار با روش تحلیلی - توصیفی، ابتدا به بررسی پیشینه پژوهشخواهی در حقوق ایران میپردازد، فلسفه بنیادین و نیروهای سازنده آن را واکاوی میکند و سپس سیاستگذاریهای حقوقی را که دربرگیرنده سیاستهای قانونی و قضایی است، مورد ارزیابی قرار میدهد. از این ارزیابیها، چنین برمیآید که سیاستگذاریهای حقوقی، در راستای سیاستهای دیگری همچون اجتماعی، اقتصادی و فرهنگی شکل گرفته است. بیگمان، سیاستگذاری بدون در نظر گرفتن عرف و انتظار اجتماعی، ابتر بوده و ریشه بسیاری از سیاستگذاریهای قانونی و قضایی در این امور نهفته است؛ هرچند که بسان طرحوارههایی ناپیدا بهدوراز دیدگان باشند. سرانجام آنکه در پیوند با پژوهشخواهی، چندین سیاست حقوقی گوناگون و پیوسته در جریان است که همگام با یکدیگر پیش میروند و هدف بنیادین آنها برقراری عدالت، نظم اجتماعی و افزایش رضایتمندی عمومی است. | ||
